We think of the federal government as having gobbled up and pre-empted so much power at the expense of the state, but right now, when you look at abortion rights, voting rights, and gay marriage, the states are very much in control of whether or not we get to exercise our constitutional rights. Some people may really want to, but can’t because of job and/or family obligations. Um, I think when they drafted the Constitution, they intended it to apply in all states, so that your rights don’t wave good-bye when you cross a border.
Agreed. I have been reviewing all the court’s decisions and the real winner in almost every case is “states rights”. The ability of the federal government to enforce constitutional rights for all citizens was severely weakened.
